Appealing a CDF decision
A decision review process is available to businesses that believe they will be adversely affected by the approval of a CDF project.
Business people who believe they will be negatively affected must notify the Chair of the Advisory Board of their request for a decision review within 15 calendar days after publication of the news release on project approvals. The request must include a written position paper outlining the nature and extent of the negative impact anticipated.
The Advisory Board will review the position paper to determine whether to hold a hearing. If the Advisory Board agrees a hearing is required, a panel consisting of not less then three members will be convened. This hearing will occur within 15 days of receipt of the request for a decision review. The Advisory Board will make its recommendation to the Minister or Ministers responsible.
